PRICING POLICY

Prices posted here on www.avid.com.ph may change without prior notice. The sudden change may be due to the suppliers’ price change or current market situations. The prices here all varies from the actual store price. Avid Sales Corporation undertakes serious effort in making sure that all the prices posted here is accurate, however errors may still occur from time to time and the price of your order will be validated as part of acceptance procedure. 

Avid Sales Corporation cannot validate the price of an item until after the order has been placed. Pricing errors may occur and www.avid.com.ph has the right to cancel any orders containing pricing errors, with no further obligations to you, even after the receipt of your order confirmation or shipping notification from www.avid.com.ph. Avid Sales Corporation, at its sole discretion may contact you for instructions on how to cancel your order and notify you with regards to the cancellation. The pricing here in www.avid.com.ph may be different from the pricing of our AV Surfer and Sony Centre by Avid retail stores.

ORDER REQUIREMENTS

For safety purposes, Avid Sales Corporation may be asking for the following requirements during delivery for a smoother transaction.

• The customer should at least have two (2) valid ID’s. They may present any of the following below:

PRIMARY ID (one of the following)

• SSS/Unified Multi-Purpose ID
• Driver’s License
• GSIS ID
• Passport

SECONDARY ID (one of the following)

• Voter’s ID
• Postal ID
• Tin ID
• Company ID
• NBI ID
• Philhealth ID

ORDER PROCEDURE

1. Orders are being processed daily (Mondays thru Sundays) from 8:00 AM to 5:00 PM. Orders placed after cut off will be processed next business day. Orders placed after 4:00PM shall be processed on the next day.
2. For verification purposes, Avid Sales Corporation may be asking you to provide additional information or requirement. Verification may take 24 hours or less after the customer has provided the additional necessary requirements needed. You will receive an email if there are any additional documents needed from you.
3. A customer is allowed to order a maximum of Five (5) units per transaction. For orders more than the stated limit, customer may send us an email via online@avid.com.ph or contactus@avid.com.ph.
4. Please take note that there are cases wherein the order cannot be processed for reasons such as:

• Product unavailability
• Delivery area is not within our scope of delivery
• Wrong or Incomplete Order details
• Customer has reached the maximum number of units that is allowed to be purchased
• Errors in product price information
• The Debit Card/Credit Card used is identified as fraud

Avid Sales Corporation has the right to refuse or cancel any order for any of these reasons.

5. Once the verification process has been completed, Avid Sales Corporation will be sending you a Confirmation Email that your order is on process.
6. Products in this website are normally available, but if in case the product you ordered is out of stock you will be notified immediately by our team via email as to when the product will be soon available. The customer is allowed to cancel their order without any charges for this circumstance.

ORDER CANCELLATION

Avid Sales Corporation reserves the right to cancel your order under any circumstances beyond the control of Avid Sales Corporation such as but not limited to:

1. Force majeure or act of God including calamity or bad weather condition, strikes, etc.
2. Out of Stock from Manufacturer
3. Product End of Life or discontinuity
4. Unexpected System Error
5. Incorrect Promotion
6. Incorrect Pricing
7. If customer refuses to follow order requirements.
8. Orders are over the limited quantity of purchase allowed per user account.
9. Order has been found to be fraudulent.

** You will be notified via email upon order cancellation.

ORDER CANCELLATION

• No cancellation for orders paid via credit card or debit card.
• For orders paid via Cash on Delivery, if your order has not been packed or shipped out yet, you may still cancel your order by sending an email with order details to online@avid.com.ph, before four o’ clock in the afternoon (4 P.M) of the same order date, otherwise, order shall proceed for delivery.

• For orders paid via bank transfer or bank deposit, orders can no longer be cancelled once payment has been verified and credited to our bank account.

PAYMENTS POLICY

2. Avid Sales Corporation will not be liable for any loss or damages arising from the following situations below

• Incorrect Billing Address entered by the customer in the Order Information
• Incorrect Payment Information entered by the customer in the Order Information
• Incorrect Remittance or Deposit by the customer with the payment of the purchased items
• Avid Sales Corporation is not in any form, responsible for any failure to proceed or error in connection related to payment, thus, the customer or user may not hold Avid Sales Corporation liable for any claims thereof.
• Avid Sales Corporation shall not incur any liability of whatever circumstances that haven’t been foreseen such as nature arising, unavoidable incident, actions of third parties including but not limited to: hackers, suppliers, government etc. As well as event of force majeure.

APPLICABLE LAW AND JURISDICTION

The Terms and Conditions stated in this site shall be interpreted, and governed by the laws in force in the Philippines and each party hereby agrees to submit to the jurisdiction of the courts of the Philippines and to waive any objections based upon venue. In case of judicial complaints, all actions shall be instituted in the proper court of the City of Manila to the exclusion of all other courts.  If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of these Terms and Conditions, which will continue in full force and effect.

ARBITRATION

Should any controversy, claim or dispute arising out of or relating to these Terms and Conditions, the issue will be referred to and finally settled by private and confidential binding arbitration before a single arbitrator held in Makati City, Philippines. The arbitrator shall be a person who is legally trained and who has experience in the information technology field in the Philippines and is independent of either party. Notwithstanding the foregoing, the Site reserves the right to pursue the protection of intellectual property rights and confidential information through injunctive or other equitable relief through the courts.

TERMINATION

In addition to any other legal or equitable remedies, we may, without prior notice, immediately terminate the Terms and Conditions or revoke any or all of the rights granted under the Terms and Conditions. Furthermore, you agree that the Site shall not be liable to you or to any other person as a result of any suspension or termination of the account. Should you be dissatisfied with the Site or with any terms, conditions, rules, policies, guidelines in operating the Site, it shall be your sole and exclusive remedy to discontinue using the Site.

SEVERABILITY

In case that any part of the terms and conditions be found to be void, invalid, unlawful, or unenforceable then such provision or part will be deemed to be severed from these terms, and the remaining terms and provisions of these terms will remain in force and constitute the agreement between you and Avid.
